CLIENT SERVICES AGREEMENT & RISK ACKNOWLEDGMENT 

Service Provider.
This Agreement is between the client identified above (“Client,” “you,” or “your”) and WSUP DOG, LLC d/b/a Hike Club (“Hike Club,” “we,” “us,” or “our”). If your final DBA/legal entity differs, replace this sentence before use.

1. SERVICES COVERED
Hike Club provides scheduled door-to-door dog adventure services that may include home pickup and return, vehicle transportation, leashed group hiking or trail enrichment, supervised rest and refreshment, basic post-hike cleanup/brush-out, treats or hydration when authorized, and digital hike updates.

Specific routes, trails, timing, pack composition and enrichment activities are selected by Hike Club based on safety, weather, trail conditions, dog compatibility, staffing and operational needs.No specific trail, mileage, elevation gain, hike duration, pickup time, return time, packmate, staff member or weather condition is guaranteed. Hike Club may shorten, relocate, modify or cancel an adventure when reasonably necessary for safety or animal welfare.

2. ELIGIBILITY, HEALTH & VACCINATION REQUIREMENTSClient represents that each enrolled dog is in suitable health for the selected service and has disclosed all known medical conditions, medications, allergies, injuries, exercise limitations, heat/altitude sensitivity, seizure history, respiratory or cardiac concerns, prior collapse, infectious illness, and other facts that could reasonably affect safe participation.

Client will provide vaccination and health records reasonably required by Hike Club, applicable law, licensing requirements, trail rules, or Hike Club’s insurer.

Hike Club may temporarily suspend service when records expire, the dog shows signs of contagious illness, or staff reasonably believe participation is unsafe. Required vaccinations include rabies, parvo, and distemper.·      

Client must promptly notify Hike Club of any new illness, injury, medication, veterinary restriction, vaccination change or significant change in stamina.·      

Client authorizes Hike Club to rely on information supplied in the onboarding questionnaire, veterinary records and later updates.·      

Hike Club is not a veterinary provider and does not diagnose medical conditions or guarantee that a dog is medically fit for hiking. 

3. BEHAVIOR, COMPATIBILITY & MATERIAL DISCLOSURES
Client must fully disclose known behavior that could affect the safety of the dog, other dogs, staff or the public, including bite history, aggression, reactivity, guarding, escape behavior, handling sensitivity, fear triggers, prey drive, vehicle/crate distress, leash lunging, removal from daycare/boarding/group play, or known conflicts with particular dogs or types of dogs.Hike Club may perform introductions, trial services, pack reassignment or additional handling measures. Acceptance into service does not guarantee permanent eligibility. Hike Club may decline, pause or discontinue service if a dog presents a safety, welfare or operational concern.Client is responsible for losses reasonably resulting from a material omission or knowingly inaccurate disclosure about the dog’s medical or behavioral history, subject to applicable law.

4. HOME ACCESS, PICKUP & RETURN AUTHORIZATION
Client authorizes Hike Club personnel to enter the designated property only as reasonably necessary to pick up or return the enrolled dog and perform agreed pet-care tasks. Client will provide accurate access instructions and will maintain a safe, functional entry method.·      

Client will identify where the dog will be located at pickup and where the dog must be secured at return (for example: crate, gated room, designated interior area or other agreed location).·      

Client is responsible for notifying Hike Club about alarms, gates, locks, other animals, household occupants, contractors, hazards or unusual conditions that could affect safe entry.·      

Hike Club may decline to enter or may leave without completing service when staff reasonably believe entry is unsafe, unauthorized or likely to allow an animal to escape.·      

Client authorizes reasonable use of towels, water and client-provided cleaning supplies when post-hike cleanup is part of the service.

5. TRANSPORTATION & RESTRAINT
Client authorizes vehicle transportation in Hike Club vehicles or another appropriate vehicle used for service delivery. Dogs may be transported in individual kennels, secured compartments, harness/restraint systems, or other configurations Hike Club reasonably selects for safety and animal welfare.Client understands that vehicle transportation carries risks including motion sickness, stress, sudden stops, collision, equipment failure, traffic delay, temperature fluctuation and emergency evacuation.

Hike Club will use reasonable care but cannot eliminate all transportation risk.Hike Club may use its own collar, harness, leash, long line, identification device, GPS device, safety tether or other handling equipment unless Client has disclosed a medical or safety restriction. Client must identify any known history of slipping collars/harnesses or damaging restraints.

6. TRAIL SAFETY, LEASHES, LONG LINES & OFF-LEASH ACTIVITY
Unless separately authorized below, Hike Club will keep the dog leashed or otherwise physically restrained as required by law, land-manager rules and Hike Club safety procedures. A long line may be used for enrichment or assessment when staff determine it is appropriate.As part of this agreement, I authorize use of a long line when Hike Club determines it is appropriate.

I also authorize Hike Club to transport my dog within the Lucky Duck premium kennels as was offered for my viewing within the Hike Club Bus.Even with permission, Hike Club is never required to allow off-leash activity and may use a leash at any time. Client understands that recall can fail and that wildlife, other animals, terrain, noise and unexpected events may affect a dog’s behavior.

7. OUTDOOR & GROUP-ACTIVITY RISK ACKNOWLEDGMENT
Client understands that outdoor dog hiking and group transportation involve inherent and other risks that cannot be completely eliminated, including uneven or slippery terrain; falls; sprains; cuts; paw or nail injuries; encounters with wildlife, insects, plants, water, snow or ice; heat, cold, lightning, smoke or rapidly changing weather; altitude; dehydration; ingestion of foreign material; encounters with people, bicycles, runners, horses or other dogs; infectious disease exposure; escape; vehicle incidents; and unpredictable animal behavior.Client voluntarily chooses these services with knowledge of those risks.

Hike Club will use reasonable safety procedures and professional judgment, but Client acknowledges that no dog-care provider can guarantee an injury-free or incident-free experience.

8. EMERGENCY CARE AUTHORIZATION
If Hike Club reasonably believes the dog requires urgent medical attention, Hike Club may provide basic first aid within staff training, discontinue the activity, transport the dog, contact Client and/or the emergency contact, and seek evaluation or treatment from a licensed veterinarian or emergency veterinary facility.

Hike Club may select the veterinary facility based on urgency, location, availability and existing provider relationships rather than delaying care to reach a particular clinic.Client authorizes Hike Club to act as Client’s limited agent solely for obtaining emergency veterinary evaluation and treatment when Client cannot be reached promptly. A veterinarian remains responsible for medical decisions and treatment recommendations.

Hike Club will seek emergency attention as needed and will initially cover costs related to hiking activity. Emergency spending authorization without prior verbal approval up to $2,500.Client is financially responsible for veterinary, ambulance/transport, medication and related third-party charges incurred for the dog, except to the extent a final determination establishes that such cost is legally the responsibility of Hike Club.

Hike Club will make reasonable efforts to contact Client before non-emergency treatment decisions when circumstances permit. (Required under Colorado Law) In the extremely unlikely event a pet should be determined as deceased, Hike Club will make every attempt to contact the pet owner – if contact is unavailable, pet’s remains will be managed by the associated veterinarian or client’s preferred veterinarian – whichever is first available for treatment.)

9. FOOD, TREATS, WATER & POST-HIKE
CAREClient authorizes reasonable hydration and rest breaks. Hike Club may refuse any client-provided food, supplement or that cannot be safely administered within service operations or applicable law.

Hike Club is not authorized to administer medication.

10. SCHEDULING, WEATHER, CANCELLATIONS & SERVICE CHANGES
Reservations, recurring schedules, cancellation windows, late-cancellation charges, weather adjustments, service credits and rescheduling are governed by the written pricing and scheduling policy presented to Client at enrollment or subsequently accepted by Client. If a service plan renews automatically, the renewal and cancellation disclosures provided for that plan control and will be administered in accordance with applicable Colorado law.Hike Club may cancel or modify a service due to weather, trail closure, wildfire/smoke, unsafe road conditions, staffing emergency, vehicle issue, animal illness/behavior, public-safety event or other condition reasonably affecting safe performance. Every effort will be given to provides a rescheduled appointment or refund, that policy applies; Hike Club does not guarantee a cash refund unless required by law or expressly stated in writing.

11. FEES, PAYMENT AUTHORIZATION & PAST-DUE ACCOUNTS
Client agrees to pay the rates, membership charges, add-ons, cancellation charges and other fees disclosed for the selected services. Client authorizes Hike Club and its payment processor to charge the payment method on file for amounts properly due under the selected plan and accepted policies.Client will maintain valid payment information. Hike Club may suspend future services for past-due balances. Any collection costs, returned-payment fees or late charges must be expressly disclosed and permitted by applicable law before they are assessed.

12. PHOTOS, VIDEO, TRAIL TALES & GPS / SERVICE DATA
Hike Club may photograph or record the dog during service for operational documentation and client updates (“Trail Tales”). GPS or similar location data may be collected from devices used on dogs, staff or vehicles for safety, route documentation and service verification. Per this agreement, you authorize use of photos/video of my dog in Hike Club marketing and social media that do not expose your home or personal information.

13. COMMUNICATIONS
Client authorizes service-related calls, texts and emails concerning scheduling, pickup/return, dog health or behavior, emergencies, billing, account administration and service updates. Marketing communications, if any, will be handled separately as required by applicable law. Client is responsible for maintaining current contact information.

14. INCIDENTS, LOST DOGS & NOTIFICATION
If a dog escapes, becomes lost, is involved in a bite or other material incident, Hike Club may take reasonable immediate action, including contacting Client, emergency contacts, animal control, law enforcement, park personnel, veterinarians, microchip registries or other appropriate resources. Client authorizes disclosure of reasonably necessary identifying and medical information for those purposes.Client agrees to cooperate promptly with incident investigation, insurer requests and legally required reporting. This section does not shift responsibility contrary to applicable law.

15.EMERGENCY CONTINGENCY PLANS
In the unlikely event of a natural disaster, hurricane, forest fire, nuclear disaster, or other life-threatening incident caused by man or upon Godswill, every attempt will be made to return pet to your home. In the event your home is inaccessible or returning your dog to your home becomes impossible, pets will be taken to Hike Club Headquarters, located at 5951 Middlefield Road, Littleton CO 80123.

In the unlikely event that Hike Club HQ is also inaccessible, pets will be taken to Hike Club owner’s place of residence at 10037 Brisbane Way, Highlands Ranch CO 80130. All pets will require ID matching ownership as recorded in the Hike Club databases for pickup. In the event that this address is also inhabitable, pets will be taken to the closest facility with your pet’s information clearly noted.

15. LIMITATION OF LIABILITY; RELEASE OF INHERENT RISKS
To the fullest extent permitted by Colorado law, Client assumes the inherent risks described in this Agreement and releases Hike Club and its owners, employees and agents from claims arising solely from those inherent risks when Hike Club has used reasonable care. This provision is not intended to waive rights that cannot lawfully be waived, excuse gross negligence or willful misconduct, or alter any responsibility imposed by applicable law.Because enforceability of liability waivers depends heavily on wording and circumstances, this section must be approved by Hike Club’s Colorado counsel and insurer before use.

16. CLIENT INDEMNITY FOR CLIENT-CONTROLLED RISKS
To the fullest extent permitted by law, Client agrees to indemnify and reimburse Hike Club for third-party claims, losses or reasonable costs caused by Client’s material misrepresentation or failure to disclose a known dangerous condition, unauthorized person or animal at the property, or known material behavior/medical history of the dog, except to the extent caused by Hike Club’s negligence or other legal responsibility.

17. SERVICE SUSPENSION OR TERMINATION
Either party may discontinue future services without cause. There is no contractual obligation by either party and may be canceled at any time. Hike Club may immediately suspend or terminate service for nonpayment, unsafe access, expired required records, material nondisclosure, repeated policy violations, or a reasonable determination that continued participation presents a safety or welfare concern.Termination does not eliminate amounts already earned or due and does not limit Client’s right to receive any refund or credit required by the applicable plan or law.

18. NO GUARANTEE; PROFESSIONAL JUDGMENT
Dogs are living animals with changing physical and behavioral responses. Hike Club does not guarantee weight loss, behavior modification, training results, social compatibility, fatigue level, cleanliness, mileage, trail difficulty, or any specific health or behavioral outcome. Staff may alter handling or activities in real time using reasonable professional judgment.

19. GOVERNING LAW; DISPUTES
Colorado law governs this Agreement, without regard to conflict-of-law principles. Before filing a non-emergency civil claim, the parties agree to make a good-faith effort to resolve the issue directly. Any mandatory venue, mediation, arbitration, jury-waiver or attorney-fee provision should be added only after review by Colorado counsel; none is imposed by this draft.

20. GENERAL TERMS·      
This Agreement, the completed onboarding questionnaire, current pricing/scheduling policy, and any written service-plan terms accepted by Client constitute the service agreement between the parties for the matters they cover.·      

If terms conflict, a specifically negotiated written amendment signed by both parties controls over general policy language.·      

If any provision is unenforceable, the remaining provisions remain in effect to the extent legally permitted.·      

Failure to enforce a provision once does not waive future enforcement.·      

Electronic signatures and electronic records may be used to the extent permitted by law.·      

Client may not transfer an account or service rights to another household without Hike Club’s consent.

CLIENT CERTIFICATIONS & AUTHORIZATIONS
By signing below, Client confirms that Client has read this Agreement, had the opportunity to ask questions, and understands the material risks and authorizations.

Client certifies that information supplied about the dog is true and complete to the best of Client’s knowledge and agrees to promptly report material changes.I attest that my dog is in suitable general health for the services I select, subject to any disclosed limitations.I have disclosed known bite history, aggression, reactivity, guarding, escape behavior, significant fear triggers and prior removal from group-care settings.I have disclosed known medical conditions, allergies, medications, exercise limitations and prior heat/altitude/exercise intolerance.I authorize pickup/return and property access according to my written instructions.

I authorize vehicle transportation and reasonable safety equipment.I understand and accept the outdoor, group-care and transportation risks described above.I authorize emergency veterinary care as selected above and accept financial responsibility as stated.I agree to the pricing, scheduling and cancellation terms separately disclosed for my selected service plan. Your digital signature serves as consent and understanding of all the terms above and is considered the same as a wet ink signature under the law.

Stage II: If Hike Club HQ is inhabitable, pets will be transported to Hike Club Owner’s Home: 10037 Brisbane Way, Highlands Ranch CO 80130.

Stage III: If Your home, Hike Club HQ, and Owner’s home all become inaccessible or inhabitable, Pets will be taken to the closest suitable facility.
